Your privacy is important to Differ Communications Limited (“we”, “us” and “our”). We are committed to ensuring that any personal information we collect is appropriately used, disclosed and protected in compliance with applicable privacy laws.

This privacy policy (the “Policy”) describes how and why we collect personal information (i.e. information about an identifiable individual). It applies to our customers and any individuals who use our products and services, including our website, apps and other digital services (“Subscribers”). This Policy also explains what we do with that personal information, including who we may disclose it to, how we protect it and who you can contact if you have any questions or concerns about your privacy. 

In some instances, our products and services may have their own specific privacy policies.

  • from third parties, such as credit reporting agencies, or other third parties with whom you have had a payment relationship.

PURPOSES THAT WE COLLECT AND USE YOUR PERSONAL INFORMATION FOR

We will use your personal information to establish and manage any commercial relationship we have with you. This may include to:

  • allow you to participate in interactive features on our website;
  • provide you with information that you request from us; 
  • confirm your identity and assess your application to become a Subscriber; 
  • provide products and services to you and personalize your user experience;
  • notify you of service issues, interruptions and changes to our products and services;
  • invoice you and collect payment for products or services purchased; and
  • ensure your compliance with applicable laws and our terms of service.

We may also use your personal information to:

  • develop, manage, evaluate and improve our products and services or business operations;
  • understand your needs, recommend products or services and send you offers and promotions that may be of interest to you;
  • perform analytics, administer surveys, or request feedback to improve and manage our relationship with you;
  • comply with our legal and regulatory requirements; and 
  • fulfill any other purposes for which you provided the information or that were described when it was collected.

We take steps to ensure that the personal information that we collect about you is adequate, relevant, not excessive, and used for limited and specific purposes. Other than as set out in this Policy, we will not sell, trade, rent, or give your information to any third party.

HOW WE OBTAIN YOUR CONSENT

When you provide us with your personal information, you consent to us using it as identified in this Policy, and for any other purpose we may describe when you provide the information. We may ask for your express consent, such as asking you to check a box, when we collect sensitive personal information, such as financial information, or when we ask for your consent to receive electronic marketing information. Your consent may be implied when we can reasonably conclude that you have given consent by your actions. For example, your continued use of our products and services indicates your consent to our collecting, using and disclosing your personal information in accordance with this Policy.

You may refuse to consent to the collection, use, and disclosure of your personal information or withdraw your consent under certain circumstances. To withdraw your consent, you can contact our Privacy Officer or visit your online Differ account at https://portal.differ.ca. Please note that if you withdraw your consent, we may not be able to provide you with certain products, services or offers. We will explain the impact to you at the time to help you with your decision. 

If you have opted in to receive certain emails from us but no longer wish to have your email address or other contact information used by us for promotional purposes, you can opt-out by sending us an email to opt-out@differ.ca, or by clicking the unsubscribe link included in electronic correspondence from us. 

WHO WE MAY DISCLOSE YOUR PERSONAL INFORMATION TO

We may disclose your personal information to:

  • a person who, in our reasonable judgement, is acting as your agent (such as a legal representative or authorized user);
  • our suppliers and contractors who assist with activities such as service installation or network maintenance;
  • our service providers and other third parties we use to support our operations (including account management, information technology, payment processing, credit assessment, payment collection and professional advisors);
  • comply with any court order, law, or legal process, including to respond to any law enforcement, government, or regulatory request in accordance with applicable law; and
  • fulfill the purpose for which you provided it or otherwise with your consent.

We may use and disclose aggregated information about our Subscribers, and information that does not identify any individual, for legitimate business purposes without restriction.

HOW WE STORE AND SECURE YOUR PERSONAL INFORMATION

The security of your personal information is very important to us. We use appropriate physical, electronic, and administrative measures designed to safeguard your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Our employees with access to personal information undertake appropriate training and are required to respect the confidentiality of personal information.

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Once your personal information is no longer required it will be destroyed, erased or de-identified.

We may process, store, and transfer your personal information outside of Canada. Whenever we engage a service provider or disclose your information to a third party, we require that the third party’s privacy and security standards to adhere to this Policy and applicable Canadian privacy legislation. However, personal information may still be subject to the laws of the jurisdiction where it is held and may be accessed by courts, law enforcement and national security authorities in that jurisdiction.

The transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the website or in our products or services. 

HOW YOU CAN ACCESS AND CORRECT YOUR PERSONAL INFORMATION

It is important that the personal information we hold about you is accurate and up to date. If any of your personal information changes, please let us know. 

You have the right to request access to the personal information that we hold about you. If you want to review the personal information in your file or correct your personal information you can contact our Privacy Officer at the details below. Some information may also be accessed and updated by you directly via your online Differ account at https://portal.differ.ca .

We may request specific information from you to help us confirm your identity before granting access to personal information that we hold about you or making your requested changes. Applicable laws may allow or require us to refuse to provide you with access to some or all of the personal information we hold about you. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.
